A recent post by the California Construction Law Blog includes some excellent suggestions on ways that contractors can protect against risks from rising material costs. These ideas include using Time & Materials Contracts that make the owner responsible for material costs, adding larger margins or cost escalator provisions in lump sump Residential and Commercial Installation Agreements, relying the Force Majeure provision of the contract to protect against not reasonably anticipated cost increases, and pre-ordering materials.
