Power Production Guaranty and Limited Warranty (Performance Guarantee)

This Power Production Guaranty and Limited Warranty (“Performance Guarantee”) is used by solar installers and/or developers to offer customers a money-back guarantee on the solar and/or storage system's production.  The Performance Guarantee provides that the installer or developer will pay to the customer an amount equal to the average cost per kilowatt hour that the customer’s utility charged for the prior 12 months for each kWh that the system fails to produce as promised.  This Performance Guarantee contains a comprehensive list of exclusions and disclaimers to protect the installer and developer.  Installers and developers often modify the duration of both the limited warranty period and the power production guarantee according to their business needs.  Key provisions in this Performance Guarantee include a money back guarantee calculation, exclusions and disclaimers, limitations of warranty scope, standards of performance, force majeure, assignment rights and dispute resolution provisions.
