Subcontractor Agreement (CA)
This Master Subcontractor Agreement (“Agreement) is for solar, wind and other renewable energy contractors who sell, install, maintain and repair renewable energy projects. It provides the terms by which a contractor will hire an individual or company to perform part of its scope of work on the project. The Agreement covers, among other things, the range of risks and liabilities that the subcontractor must agree to accept, the scope of work the subcontractor must perform, work specifications that match the contractor’s agreement with the purchaser, how the work will be paid and the right to retain a set amount until final acceptance, a work schedule that meets the contractor’s deadlines, indemnification of the contractor in the event of a purchaser or other third-party claim, warranty obligations and adequate insurance requirements. This Agreement is designed as a master agreement that can be used for an ongoing relationship with the subcontractor, if desired. Contractors not located in California might prefer our version of this Subcontractor Agreement that does not contain California specific provisions.
