This Lead Generator Services Agreement (“Agreement”) is designed for lead generators and cleantech brokers who will work with licensed contractors without registering as their salesperson. The Agreement is intended to comply with state laws, such as California’s, which contain restrictions on lead generation and brokering services in certain industries, such as for residential solar, storage and energy efficiency construction and sales. Among other key protections, it includes sections designed to protect both parties related to licensing requirements, scope of services, fees and commission. An optional exclusivity and first right of refusal is included. The lead generator receives a flat fee per lead generated and a commission on leads that become completed sales.
